  9. LICENSE AGREEMENT

  11. YOU SHOULD READ CAREFULLY THE FOLLOWING TERMS AND CONDITIONS BEFORE USING OR
  12. DISTRIBUTING THIS SOFTWARE. USING OR DISTRIBUTING THIS SOFTWARE INDICATES 
  13. ACCEPTANCE OF THESE TERMS AND CONDITIONS.

  17. AY Mail software program (hereafter the "Software") and documentation 
  18. (hereafter the "Documentation") is copyrighted and remains the property 
  19. of Andrey B. Yastrebov (hereafter the "Author". All rights are reserved.

  21. LICENSE 
  22.  
  23. The Author hereby grants you ( hereafter the "Purchaser") a limited, 
  24. non-exclusive license to use the Software and accompanying Documentation 
  25. contained in the shareware distribution package (hereafter called the 
  26. "Shareware Package") or purchased distribution package (hereafter called 
  27. the "Registered Package") you received. The Shareware Package consists of
  28. copies of the Software and Documentation received via an electronic transfer 
  29. mechanism or an electronic storage medium including, but not limited to, 
  30. diskette, hard disk, removable disk, tape or optical devices such as CD-ROM 
  31. or WORM, which have not yet been purchased. The Shareware Package limits
  32. number of recipients to whom messages can be sent to THREE. The Registered 
  33. Package consists of copies of the Software and Documentation received via 
  34. an electronic transfer mechanism or an electronic storage medium including, 
  35. but not limited to, diskette, hard disk, removable disk, tape or optical 
  36. devices such as CD-ROM or WORM, which have been purchased. The Registered
  37. Package does not have a limit on number of recipients other that imposed
  38. by used hardware and software. The Registered Package differs from The
  39. Shareware Package by presence of Digital License File AYMAIL.LIC.

  41. You may use the Software and Documentation for any purposes expect for
  42. spamming. Spamming is broadcasting of untageted messages, regardless
  43. of number or purposes.

  45. You may use the Software or Documentation on one or more computers provided 
  46. there is no chance that it will be installed simultaneously on more than one 
  47. computer.

  49. You are not obtaining title to the Software or Documentation or any copyright 
  50. rights. You may not sublicense, lease, rent, sell, convey, translate, modify, 
  51. decompile, incorporate into another product, convert to another programming 
  52. language, reverse engineer or disassemble the Software or Documentation for 
  53. any purpose.

  55. TERM AND TRIAL PERIOD

  57. You are permitted to use the Shareware Package for a trial period (hereafter 
  58. the "Trial Period") of a maximum of tventy-eight (28) days after receipt of 
  59. the Shareware Package. After such time, if you continue to use the Shareware 
  60. Package, you must purchase your copy from the Author. Upon said purchase, the 
  61. Shareware Package is replaced with the Registered Package and all Registered 
  62. Package license terms described herein then become applicable. Failure to 
  63. register after the Trial Period constitutes termination of this license. 
  64. The Registered Package may not be used without first having purchased the
  65. Software and Documentation.

  67. This license is effective until terminated. You may terminate it by destroying 
  68. the Software, Documentation, and all copies thereof. This license will also 
  69. terminate if you fail to comply with any of the terms or conditions herein. 
  70. You agree, upon such termination, to destroy all Software, Documentation, 
  71. and copies thereof.

  73. LIMITED WARRANTY

  75. THE SOFTWARE AND DOCUMENTATION IS PROVIDED "AS IS" WITHOUT WARRANTY 
  76. OF ANY KIND. THE AUTHOR DISCLAIMS ALL WARRANTIES RELATING TO THIS SOFTWARE, 
  77. WHETHER EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY IMPLIED 
  78. WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, AND 
  79. ALL SUCH WARRANTIES ARE EXPRESSLY AND SPECIFICALLY DISCLAIMED. IN NO EVENT 
  80. SHALL THE AUTHOR OR ANYONE ELSE WHO HAS BEEN INVOLVED IN THE CREATION,
  81. PRODUCTION, OR DELIVERY OF THIS SOFTWARE SHALL BE LIABLE FOR ANY DIRECT, 
  82. INDIRECT, CONSEQUENTIAL OR INCIDENTAL DAMAGES, ARISING OUT OF THE USE OR 
  83. INABILITY TO USE SUCH SOFTWARE EVEN IF THE AUTHOR HAS BEEN ADVISED OF THE 
  84. POSSIBILITY OF SUCH DAMAGES OR CLAIMS.

  86. BACKUP

  88. You may make as many copies of the Shareware Package as you need for backup 
  89. purposes only.

  91. DISTRIBUTION

  93. You cannot distribute the Registered Package. Nor can you distribute
  94. Digital License alone or as a part of any package. 
  95.  
  96. You may distribute the Shareware Package to others via an electronic transfer 
  97. mechanism or electronic storage media provided that no files are deleted from 
  98. the Shareware Package or are modified in any way. Files may be added to the
  99. Shareware Package expressly for the purpose of identifying the party 
  100. distributing the Shareware Package. You may also place the Shareware Package 
  101. into any archive or compressed format for ease of distribution.
